General Terms and Conditions DKMF Fight Concepts

Every athlete is obliged to take note of the General Terms and Conditions of DKMF Fight Concepts. If there is an agreement between DKMF Fight Concepts and the athlete, these General Terms and Conditions are a part of it and are inseparably linked to it.

Membership & Contribution

1. Upon registration, you pay the first month and the registration fees before the first training session via the payment link included in the welcome message following your registration form. During the term of the membership, the contribution must be paid monthly in advance.

2. Every month - approx. 14 days before the upcoming training month - an email is sent to the email address provided by you upon registration containing the contribution invoice. In a separately sent WhatsApp message, you will receive the corresponding payment link. DKMF Fight Concepts requests you to settle this before the end date stated in that message.

3. You are responsible for the proper functioning and validity of the email address and telephone number.

4. If your address, telephone number, email address, subscription, membership, etc., changes, you must report this change immediately.

5. Pay on time!! For every REMINDER after late payment, € 7.50 in costs will be charged. After the third REMINDER, the claim will be handed over to a collection agency. This entails high additional costs – a minimum of € 45.00 for the first collection letter. Reminders provide a 3-day extension of payment.

6. In the event of late payment, training is not permitted.

7. All rates can be found on our site.

8. Your membership continues until cancellation. This can be done – exclusively online - at any time via the cancellation form, but before the contribution invoice for the upcoming period has been sent. Contribution invoices are sent approximately 14 days before the start of the new period. If an invoice is still outstanding, it must be paid before the cancellation can be processed.

Cancellations via other media or channels are not possible.

There can be no refund of - part of - the contribution. If the new contribution invoice has already been sent, it must be paid before the termination is handled.

9. If there is a payment arrears, cancellation is not possible; contributions will continue, and in case of refusal of payment, the claim will be handed over for collection. Please note: this entails high additional costs – at minimum € 45.00 for the first collection letter. Simply stopping training and no longer paying is NOT the way to cancel.

10. During holiday periods - including private holidays or during other private reasons for long-term absence - and public holidays, contributions continue; training will in principle - if opportunities arise - continue according to a holiday schedule to be established. If you cancel before a holiday period and then re-register after the holiday period, you must pay the registration fee again. Any discount promotions in which you previously participated will then expire.

11. Payments once made will never be refunded.

12. Contributions also continue during long-term illness or injuries. Pausing / freezing memberships is not an option.

13. Long-term contracts exist in two forms:

(a) The annual subscription for regular training is collected monthly. It is not possible to cancel this contract prematurely. This annual contract is tacitly renewed after 12 months for a new contract with a duration of one year. If the member so desires, they can also switch to a monthly cancelable contract after 12 months. The member must take timely action for this change themselves.

(b) Annual contracts for instructor training and the Jeugdfonds Sport & Cultuur. These are annual contracts that are converted - if desired - into a monthly cancelable contract after completion. Premature cancellation of annual contracts is not possible. Nor is restitution.

14. Discounts and contribution increases

(a) Contributions are in principle never increased during the term unless imposed measures are in place.

(b) If one is registered with a discount from a promotion or otherwise, the contribution is never increased to the higher rate unless the promotion has a limited duration. Upon cancellation and re-registration, discounts expire and the rate valid at the time of re-registration applies without discount.

(c) Combined discounts are not permitted.

General

15. In principle, a minimum age of approx. 16 years applies for participation in the training sessions, also depending on physical and general development.

16. You must be present at least 10 minutes before training time.

17. The instructor reserves the right to remove students from the training location and/or terminate the membership unilaterally in case of disturbing or deviant behavior before, during, or after training. The use of Krav Maga Hybrid, Eskrima, and/or Hybrid Combat System outside the training locations is only permitted for necessary defense of yourself or third parties when there is a real, immediate danger to the well-being of that person(s). In all situations, the application of Krav Maga Hybrid, Eskrima, and/or Hybrid Combat System must be proportional and subsidiary. The use of Krav Maga Hybrid, Eskrima, and/or Hybrid Combat System for illegal purposes results in immediate termination of membership and reporting to the competent authorities.

18. Every student who actively participates in Krav Maga Hybrid, Eskrima training, and/or Hybrid Combat System must have compulsory Liability Insurance (W.A.-verzekering). Damage you may cause to others is then covered.

19. The dojo/hall is only left during a training session after notification and with the approval of the instructor.

20. Necessary respect is shown to our training partner and you observe standard codes of conduct. If he/she requests you to stop or to perform the exercises (more) calmly, you must do so.

21. You train with the person who invites you or who is assigned to you by the instructor.

22. Uncontrolled aggression will not be tolerated. Uncontrolled training - which can result in injury or spoiling the training pleasure of others - is not accepted.

23. If you injure someone during class, you must take them to a doctor or emergency room yourself; otherwise, the lesson cannot continue for the entire group. Any damage/costs can be recovered from you.

24. If you train/practice with a newcomer or someone with a lower training level, you must adapt to that lower level. Your primary task is then to help that person reach a higher level.

25. No persons other than members and those attending a trial lesson by appointment are permitted on the training floor.

26. Mobile phones etc. are turned off. In case of expected emergencies or otherwise, this must be reported to the instructor.

27. Eating during training is not permitted. If you have a medical urgency, you must report this to the instructor. Water bottles are allowed.

28. Smoking is prohibited.

29. Participants under the influence (alcohol, drugs, or otherwise) will be removed immediately.

30. Making recordings of any kind during training is not permitted without permission.

31. Injuries and other physical or psychological discomforts, etc., must be reported to the instructor before the start of training.

HYGIENE, CLOTHING, PROTECTION AND EQUIPMENT

32. Everyone maintains good personal hygiene, such as short and clean nails, clean sportswear, etc.

33. Wounds are bandaged and any blood is removed from the floor or mat. Students are required to have a basic First Aid kit with them during training consisting of at least plasters and tape of good quality.

34. Piercings, jewelry, glasses, etc. are not allowed for safety reasons. Some piercings can possibly be taped; this is at the discretion of the instructor. Wearing contact lenses is at your own risk.

35. Long hair must be tied back with an elastic band without sharp or hard parts.

36. All necessary training materials can be purchased from the instructor. To prevent the purchase of incorrect materials, it is discouraged to buy items on your own without prior consultation. This prevents disappointment afterwards.

37. Prescribed clothing: black long training pants and T-shirt; sleeves and trouser legs not rolled up. Furthermore, every student must be in possession of a mouthguard, MMA gloves, and a groin guard (toque). Recommended for ladies is a sports bra with flexible hard plastic protectors.

38. The dojo / hall may only be entered with indoor shoes. For injury prevention, training only in socks is not allowed.

39. Within one month after joining Eskrima training, students must have their own set of practice weapons which are present at every training session: kubotan, rattan stick approx. 70 cm, and a metal practice knife.

40. Although they are only practice weapons, with the exception of the kubotan, they should only be transported from home to the gym and vice versa, not visible in a closed sports bag.

41. Punching and kicking pads etc. are provided by the teaching organization. In connection with the weapons law, practice pistols cannot be purchased; these are therefore exclusively provided by the instructor.

LIABILITY

42. Participation in Krav Maga Hybrid, Eskrima, and Hybrid Combat System training at DKMF Fight Concepts is entirely at your own risk. DKMF Fight Concepts, the instructor, and the assistant or substitute appointed by the instructor are not liable for loss, theft, or damage to or of goods. DKMF Fight Concepts, the instructor, and the assistant or substitute appointed by the instructor also accept no liability for personal or bodily injury and resulting damage to participants in the Krav Maga Hybrid, Eskrima, and Hybrid Combat System training sessions.

43. By signing the registration form, the application form, or the membership form, the student declares that he/she will receive the sports instruction in question exclusively at his/her own risk and that costs of any accident or injury are entirely borne by him/her. Students are aware that practicing Krav Maga Hybrid, Eskrima, and Hybrid Combat System can involve risks and that he/she takes any consequential damage resulting from the practice of Krav Maga Hybrid, Eskrima, and Hybrid Combat System and/or the practice of sports disciplines (e.g., another martial art) and/or performing a profession in combination with practicing Krav Maga Hybrid, Eskrima, and Hybrid Combat System at his/her own risk. The student will also indemnify DKMF Fight Concepts and/or its management and instructors against claims from third parties in this regard.

In cases not provided for in these regulations, the management decides.

DKMF Fight Concepts reserves the right to adjust and/or change these regulations.

Our website and/or service does not intend to collect data about website visitors who are younger than 16 years old. Unless they have permission from parents or guardian. However, we cannot check whether a visitor is older than 16. As long as the membership/engagement with DKMF Fight Concepts lasts. Data is destroyed immediately after cancellation.

• Cookies, or similar techniques, that we use
DKMF Fight Concepts does not use cookies or similar techniques.

• Viewing, adjusting or deleting data
You have the right to view, correct or delete your personal data. In addition, you have the right to withdraw your consent for data processing or to object to the processing of your personal data by DKMF Fight Concepts and you have the right to data portability. This means that you can submit a request to us to send the personal data we have about you in a computer file to you or another organization mentioned by you.

You can send a request for inspection, correction, deletion, data transfer of your personal data or request for withdrawal of your consent or objection to the processing of your personal data to info@kravmaga-hybrid.com.

To ensure that the request for inspection has been made by you, we ask you to send a copy of your proof of identity with the request.
